Green Card through Marriage

Every year, thousands of people receive a US green card—permanent residency—through marriage to a US citizen. When a foreign national marries a US citizen and is in the US, the foreigner must apply for an adjustment in immigration status through the United States Citizenship and Immigration Service (USCIS). If the foreigner is outside the United States, you will be interviewed at the U.S. consulate closest to your home in a process called Consular Processing.

Adjustment of Status Process

The process of acquiring permanent residency through marriage to a US citizen is not automatic and must be done correctly. After the marriage, the citizen must file an I-130, and the foreign national must file the application for adjustment of status, I-485. There is a medical examination, an interview, and, if all goes well, permanent residency (green card) is granted. If the marriage is less than two years old, the permanent residency status is issued conditionally.

How an Experienced Immigration Lawyer Can Help

At Foley Law Offices, P.C., we complete all the necessary forms, assemble the documentation requested, and accompany you to the interview. We offer interview preparation to the foreign spouse. Based on our extensive experience with adjustment of status through marriage, we are able to provide the foreign national with detailed information on possible questions that might be asked during the interview.

Conditional Status

If the permanent residency status was granted conditionally, our attorney arranges to file the I-751 to remove the conditions at the designated time frame. A second interview may be required, along with specific documentation to validate the marriage. Again, our firm files the required forms and documentation, and attends the interview.
